Fitness for Duty
If the employer requires, the employee must submit for an independent exam to obtain medical certification of the employee's fitness to return to work if FMLA leave was taken for the employee's own serious health condition Re-Certification
An Employer may request Re-Certification at any reasonable interval, but not more than every 30 days.
2nd Opinion
If an employee submits a completed certification signed by a health care provider, a health care provider representing the employer may contact the employee's health care provider, for purposes of clarification and authenticity of medical certification. A 2nd opinion certification is issued utilizing evidence based criteria to authenticate or refute the original medical certification. However, a health care provider representing the employer may contact the employee's health care provider, for purposes of clarification and authenticity of the medical certification. 3rd Opinion
If the opinions of the employee's and employer's designated health care provider differ, the employer may require the employee to obtain certification from a third health care provider, again at the employer's expense. The third opinion shall be final and binding. The third health care provider must be designated or approved jointly by the employer and the employee.
